Terms of service

1. Object and acceptance

These Terms of Service (the 'Terms') govern access to and use of the AXION platform (the 'Service'), provided by AXION FIT S.L. (hereinafter, 'AXION'), with registered address in Spain and contact email hola@axion.com.es. By creating an account or using the Service, you confirm that you have read, understood and accept these Terms in full. If you do not agree, you must not use the Service.

2. Service description

AXION is a SaaS platform for personal coaches and trainers that enables online client management, programming of training and nutrition plans, payment tracking and AI-assisted insights. The Service is offered as-is and AXION reserves the right to modify, suspend or discontinue features at any time, with reasonable prior notice when material.

3. Account registration

To use the Service you must create an account providing accurate, up-to-date information. You are responsible for keeping your access credentials confidential and for all activity performed under your account. You must notify AXION immediately at hola@axion.com.es of any unauthorized access.

The Service is intended exclusively for users over 18 years of age. By registering you declare that you meet this requirement.

4. Subscriptions and payments

Access to certain features requires a paid subscription. Prices, billing cycles and conditions are detailed at the time of subscription. Payments are processed by Stripe; AXION does not store complete payment data on its servers.

Subscriptions automatically renew unless cancelled prior to the end of the current cycle. You can cancel at any time from your account; cancellation is effective at the end of the paid period and does not entitle you to a pro-rata refund except where required by mandatory consumer law.

AXION may modify pricing with at least 30 days' notice. Continued use after the effective date implies acceptance of the new price.

During the beta phase, access is offered to a limited number of founder seats at a launch price; AXION does not offer a permanent free plan. The founder price applies during the private beta and is a time-limited discount; AXION may revise it with the prior notice stated above. The €50/month reference price is an estimate of the future public price and is not a binding commitment. Billing during the beta may be handled manually until full payment integration.

Right of withdrawal (EU consumers): you have 14 calendar days to withdraw from the contract. However, by requesting immediate access to the Service you expressly agree that performance begins before that period ends and acknowledge that, once the Service has been fully performed, you lose your right of withdrawal (art. 103.m of the Spanish TRLGDCU).

5. Acceptable use

You commit to using the Service in accordance with applicable law and these Terms. The following are expressly prohibited: (i) any illegal, fraudulent or harmful use; (ii) attempting to circumvent technical security measures; (iii) reverse engineering, decompiling or extracting source code; (iv) using the Service to send spam or unsolicited content; (v) impersonating third parties or providing false information; (vi) automating access in a way that affects platform performance.

6. Content of coach and clients

You retain ownership of the content you upload (workouts, nutrition plans, photos, messages, etc.). By using the Service you grant AXION a limited, non-exclusive, worldwide licence to host, reproduce and transmit that content for the sole purpose of providing the Service.

Each coach is responsible for the legality and accuracy of the content and recommendations provided to their clients through the platform. AXION is a tool; it does not provide medical, nutritional or health advice and is not responsible for the professional decisions of coaches.

7. Intellectual property of AXION

The Service, including software, design, trademarks, logos and accompanying documentation, is the property of AXION FIT S.L. or its licensors and is protected by intellectual property law. The Terms do not grant you any rights other than the limited licence to use the Service in accordance with these Terms.

8. Limitation of liability

To the maximum extent permitted by applicable law, AXION shall not be liable for indirect, incidental, special or consequential damages, loss of profit, business or data, even if advised of the possibility of such damages.

AXION's aggregate liability under these Terms is limited to the amount paid by you for the Service in the 12 months prior to the event giving rise to liability.

AXION does not guarantee that the Service will be uninterrupted, error-free or completely secure. We use reasonable measures to maintain availability and security, but cannot guarantee absolute results.

9. Suspension and termination

AXION may suspend or terminate your access in the event of breach of these Terms, fraudulent use or non-payment, with notice when possible. You may terminate your account at any time from the platform settings; the data retention policy is detailed in our Privacy Policy.

10. Personal data

Personal data processing is governed by our Privacy Policy, available at /privacy. By accepting these Terms you confirm that you have read that policy.

11. Modifications

AXION may update these Terms when there are legal, technical or operational changes. We will publish the updated version on the platform and, in the case of substantial changes, will notify by email with at least 15 days' notice before they become effective.

12. Applicable law and jurisdiction

These Terms are governed by Spanish law. For any dispute, the courts and tribunals of the city of registered office of AXION FIT S.L. shall have exclusive jurisdiction, except where mandatory consumer law provides otherwise.
